Terms of Use
Last updated August 8, 2026. These terms govern your access to and use of captainwoo.com. Please read them before using the site.
Agreement to these terms
captainwoo.com (the "Site") is owned and operated by VRAW 9313, LLC, doing business as CaptainWoo ("CaptainWoo," "we," "us," or "our"). By accessing or using the Site you agree to these Terms of Use. If you do not agree, please do not use the Site. If you use a specific service or resource on the Site that has its own posted terms, those terms apply in addition to these.
Content is informational, not a proposal
The Site describes our services, technology, and past work for general informational purposes. Nothing on the Site is an offer, quote, warranty of results, or binding commitment to perform services. Case studies, metrics, and performance figures describe past engagements and specific conditions, and they are not a guarantee of the same outcome for your project. Any engagement is governed by a separate written agreement signed by both parties, which controls if it conflicts with these terms.
Communications and consent
When you submit a form or give us your contact details, you agree that we may contact you about your inquiry by email, phone, or text at the contact information you provide. You confirm you are authorized to receive communications at that number and address. Message and data rates may apply. You can opt out of marketing messages at any time by replying STOP to a text, using the unsubscribe link in an email, or asking us directly. We may still send transactional messages about an active project or support ticket. Calls may be recorded or summarized for quality and accuracy where permitted by law, and we will tell you when that applies.
Acceptable use
You agree not to:
- Use the Site for any unlawful, deceptive, or infringing purpose.
- Attempt to gain unauthorized access to the Site, accounts, servers, or networks, or probe, scan, or test their vulnerability without our written permission.
- Interfere with the Site's operation, including through denial of service attempts, malware, or excessive automated requests.
- Scrape, crawl, harvest, or bulk download Site content, or use it to train machine learning models, without our prior written consent.
- Reverse engineer, decompile, or copy our software, systems, designs, or technology.
- Impersonate any person or misrepresent your affiliation with any person or entity.
- Submit content that is unlawful, defamatory, harassing, or that infringes another party's rights.
We may investigate and take appropriate action, including restricting access, removing content, or reporting activity to law enforcement.
Intellectual property
The Site and its content, including text, graphics, logos, animations, code, software, systems, methods, and know-how, are owned by or licensed to CaptainWoo and are protected by copyright, trademark, trade dress, and other laws. "CaptainWoo" and our logos are our marks. We grant you a limited, revocable, non-exclusive license to view and use the Site for your own internal, non-commercial evaluation of our services. All other rights are reserved. No license to any of our intellectual property is granted by implication.
Third party names, marks, and screenshots shown in our work section belong to their respective owners and are used to identify projects we have delivered.
Submissions and feedback
Do not send us confidential information through the Site before a confidentiality agreement is in place. If you send us ideas, suggestions, or feedback about our services or the Site, you grant us a perpetual, worldwide, royalty free license to use it without obligation or compensation. You remain responsible for the accuracy and lawfulness of anything you submit, and you confirm you have the right to share it.
Third party sites and services
The Site links to third party websites, client applications, and platforms we do not control. We provide those links for convenience only and do not endorse and are not responsible for their content, security, or practices. Your use of a third party service is governed by that party's terms.
Accessibility
We design the Site to be usable by people with and without disabilities and we take accessibility seriously. If you run into an accessibility or usability problem, call (808) 351-5713 or use our contact form and we will work to resolve it.
Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that the information on it is complete or current. Uptime and performance commitments, where they exist, apply only to services delivered under a signed agreement, not to this marketing Site.
Limitation of liability
To the fullest extent permitted by law, CaptainWoo and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if we have been advised of the possibility. Our total aggregate liability related to the Site will not exceed one hundred US dollars ($100.00). Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless CaptainWoo and its members, officers, employees, and contractors from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Site, your violation of these terms, or your violation of any law or third party right.
Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. If that fails, the exclusive venue for any dispute is the state or federal courts located in Maricopa County, Arizona, and both parties consent to personal jurisdiction there. Each party waives any right to a trial by jury and to participate in a class or representative action. Any claim must be brought within one year after it arises.
Changes to the Site and these terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these terms, and changes take effect when posted with a new "Last updated" date. Your continued use of the Site after a change means you accept the revised terms. If any provision is held invalid or unenforceable, it will be limited or severed and the remaining provisions will stay in effect.
